The second intersessional working group established under the WIPO Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) met from 21-25 February 2011, in Geneva, Switzerland, and addressed traditional knowledge. It was followed by the third intersessional working group, which addressed intellectual property and genetic resources from 28 February to 4 March 2011.

Experts Develop Streamlined Text on TK for IGC Negotiators

According to a WIPO release, the second intersessional working group met in a constructive working atmosphere. Experts met in plenary and open-ended informal drafting groups and worked intensively on text on the protection of TK, addressing questions including the definition of TK, beneficiaries of protection, and the scope of rights to be granted and their management and enforcement. Experts Advance in Technical Discussions on IP and Genetic Resources

Experts meeting at the third intersessional working group worked in plenary and in an open-ended drafting group. The resulting text on objectives and principles contains five main objectives on conditions for access to and use of genetic resources, the prevention of erroneous patents, information systems to enable patent offices to make proper decisions in granting patents, the relationship between IP and other relevant international agreements and processes, and the role of the IP system in relation to genetic resources. IWG 3 also undertook an extensive discussion of several options for future work, including a proposed mandatory disclosure requirement, defensive databases and IP clauses in mutually agreed terms for access and equitable benefit-sharing.
